§ 11-1. Roller skates and skateboards.

  • (a)

    The operation by any person of roller skates and/or skateboards anywhere in the city shall be governed by the terms of this section. As used in this section, to roller skate means to skate on any type of roller skates or street skates.

    (b)

    No person shall roller skate or ride a skateboard on any street. No skateboard ramp shall be constructed, used or maintained on any street or sidewalk.

    (c)

    No person shall roller skate or ride a skateboard in a reckless or negligent manner on any public sidewalk. No person shall ride a skateboard or roller skate on a sidewalk without exercising due care for the safety of other persons using the sidewalk. No person shall fail to exercise full control over roller skates and/or skateboard. No person shall operate a skateboard from the sitting or prone position. No person shall operate a skateboard or roller skates while hanging on to another vehicle (including a bicycle or another skateboard or another skater).

    (d)

    No person shall roller skate or ride a skateboard or bicycle on the area known generally as the Downtown Cumberland Mall, which is bounded by Mechanic Street, Queen City Drive, Frederick Street and Harrison Street, or on the sidewalk area from Baltimore Street leading to the Western Maryland Station, the MPA Parking Garage located on S. George Street, or any MPA administered parking lot.

    (e)

    No person shall roller skate or ride a skateboard on private property without permission from the owner or other person in charge of the premises.

    (f)

    The provisions of this section shall be enforced by the police department. Any violation of any provision of this section shall be a municipal infraction and the violator shall be fined twenty-five dollars ($25.00). In addition, the skateboard or roller skates may be impounded by the police officer. Upon payment of the fine, the skateboard may be reclaimed by the offender or, where the offender is a minor, his parent or guardian. If an impounded skateboard or roller skates have not been reclaimed from impoundment within thirty (30) days from the date of offense, then the skateboard or roller skates shall be deemed abandoned and shall be disposed of in the same manner as abandoned bicycles.
