§ 13-46. Fines.

  • (a)

    Any person violating any of the provisions of this chapter, Ann. Code of Md. Art. Transportation, or the rules and regulations of the Mayor and City Council of Cumberland referring to parking violations at parking meters, upon the issuance of a citation and conviction thereof, shall be fined an amount of twenty-five dollars ($25.00). Continuous parking for each period exceeding the period lawfully allowed by each meter shall be considered a separate offense; provided, however, that no more than two (2) citations shall be issued to any person so parking within a twenty-four-hour period. If payment of the fine provided in this section is not made within thirty (30) days from the date of conviction, then notice of nonpayment shall be issued, and an administrative fee of twenty-five dollars ($25.00) shall be assessed. If no payment of the fine and administrative fee is made, then the police department shall notify the motor vehicle administration of the outstanding fine, and the owner of the vehicle so unlawfully parked shall be flagged in accordance with the pertinent provisions of the Annotated Code of Maryland, the rules and regulations of the city police department, and the rules and regulations of the department of transportation, motor vehicle administration.

    (b)

Transportation or the rules and regulations of the Mayor and City Council of Cumberland referring to parking violations in posted time zones, upon the issuance of a citation and conviction thereof, shall be fined an amount of twenty-five dollars ($25.00). Continuous parking over a twenty-minute period shall be considered a separate offense; provided, however, that no more than two (2) citations shall be issued to any person so parking within a twenty-four-hour period. If payment of the fine provided in this section is not made within thirty (30) days from the date of conviction, then notice of nonpayment shall be issued, and an administrative fee of twenty-five dollars ($25.00) shall be assessed. If no payment of the fine and administrative fee is made, then the police department shall notify the motor vehicle administration of the outstanding fine, and the owner of the vehicle so unlawfully parked shall be flagged in accordance with the pertinent provisions of the Annotated Code of Maryland, the rules and regulations of the city police department, and the rules and regulations of the department of transportation, motor vehicle administration.

    (c)

Transportation or the rules and regulations of the Mayor and City Council of Cumberland referring to any and all parking violations other than those enumerated in subsections (a) and (b) of this section, upon the issuance of a citation and conviction thereof, shall be fined an amount of twenty-five dollars ($25.00). Continuous parking over a twenty-minute period shall be considered a separate offense; provided, however, that no more than two (2) citations shall be issued to any person so parking within a twenty-four-hour period. If payment of the fine provided in this section is not made within thirty (30) days from the date of conviction, then notice of non-payment shall be issued, and an administrative fee of twenty-five dollars ($25.00) shall be assessed.     (d)

    If any vehicle is flagged in accordance with the provisions of this section, then, in addition to any fine imposed under this section and in addition to the five-dollar administrative fee, a processing fee of ten dollars ($10.00) shall be assessed, plus any other fees which might be imposed by the department of transportation, motor vehicle administration.
